Changes to Child Custody and Visitation
Requests for child custody modification and visitation modification can be made for a variety of reasons. In extreme situations, these changes may be necessary because of concerns of child endangerment. More commonly, however, are situations in which the picture changes, either due to work schedules, relocation or other factors.
Changes to Child Support
Child support is determined initially based on the financial circumstances present at the time of the divorce. When these circumstances change, child support orders may need to be changed as well. Job losses causing a reduction in income or a substantial promotion resulting in an increase in income are situations that may require a change.
Modifications of child support orders may also be required because of a child's situation. If unexpected medical expenses arise, for example, child support payments may need to increase.
Changes to Court-Ordered Spousal Maintenance
Court-ordered spousal maintenance, is subject to modification if there has been substantial changes in the financial circumstances of either the paying or receiving party, or if the receiving party has remarried. Contractual alimony, by contrast, is not generally subject to being modified.
